By reserving a charter or utilizing our Service, you acknowledge and consent to these Terms. Access to the Service is not permitted if you do not agree with any section of these terms.

2. Service Overview

OpenCommonsConclave offers a range of high-end yacht charter services, including but not limited to:

• Day-to-day yacht hire
• Evening cruises
• Business retreats
• Exclusive gatherings
• Extended charters

We are subject to availability and the state of the weather and maintain the right to alter or cease any service without prior warning.

3. Booking and Reservations

3.1 Booking Process

Charter reservation requirements include:

• Minimum age of 18 years for booking
• Providing valid and comprehensive details
• Paying the specified deposit according to your booking confirmation
• Acceptance of these Terms & Conditions

3.2 Confirmation

A confirmed booking is only established upon payment receipt and our formal confirmation. We reserve the right to decline service to any person at our own discretion.

3.3 Availability

Charter services are reliant on the availability of boats and acceptable weather conditions. We shall endeavor to accommodate your requested dates and times as best as possible.

4. Payment Terms

4.1 Pricing

Our quoted prices are in € and account for all applicable taxes unless indicated otherwise. Prices are subject to modification without prior notice.

4.2 Payment Schedule

• Initial Deposit: 50% of the total cost of the charter, due at the time of booking
• Final Payment: Required 48 hours in advance of the charter departure
• Incidental expenses (if applicable): Payable upon the charter's conclusion

4.3 Payment Methods

Our accepted payment methods include major credit cards, bank wire transfers, and bank-certified cheques. All payments are processed via secure, encrypted procedures.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• More than 72 hours prior to departure: Full reimbursement minus service fees
• Between 24-72 hours before departure: 50% of payment refunded
• Under 24 hours before the departure: No refund provided

5.2 Weather-Related Cancellations

Should the weather be considered hazardous by our captain, you will be extended the option to:

• Reschedule to another available date with no extra fees
• Receive a full refund in case of inability to reschedule

5.3 Mechanical Issues

If mechanical faults occur with your designated vessel, we will strive to arrange a suitable replacement. If no alternative vessel is accessible, we will issue a complete refund.

6. Safety and Conduct

6.1 Safety Requirements

All guests are required to:

• Heed all instructions from the crew
• Use the safety gear provided when necessary
• Disclose any medical conditions that may impact their safety
• Stay within designated spaces on the yacht

6.2 Prohibited Items

The items listed below are not allowed on board:

• Glass bottling
• Illegal drugs
• Weapons of any kind
• Intoxicants in amounts exceeding what is considered moderate (replacing alcoholic references)
• Pets (with exceptions subject to prior approval)

6.3 Conduct

Guests should behave in a considerate and respectful manner. A charter may be terminated sooner than planned without any refund if passenger conduct endangers safety or disturbs the enjoyment of the charter for others.

7. Liability and Insurance

7.1 Our Liability

Our accountability is constrained to the charter cost that has been paid. We hold no responsibility for the following:

• Injuries sustained due to personal disregard
• The loss or damage of personal belongings
• Not responsible for indirect, incidental, or punitive losses
• Delays enforced by weather or events that are beyond our control

7.2 Insurance

We maintain extensive marine insurance for our fleet and operations. Passengers ought to ensure their own travel and personal insurance coverage.

7.3 Assumption of Risk

Participation in our yacht services means an acknowledgment of inherent risks associated with maritime activities. You accept responsibility for your personal safety and security.

8. Modifications and Itinerary Changes

Itinerary amendments, as well as adjustments of routes or timetables, may occur due to weather conditions, safety matters or operational requirements. We will strive to provide an equivalent experience wherever possible.

9. Force Majeure

We shall not be held accountable for any delays, cancellations, or alterations caused by events beyond our control, including but not confined to:

• Severe meteorological conditions
• Catastrophic events
• A state of legal restraint
• Harbor closures
• Technical malfunctions

10. Privacy and Data Protection

We respect your personal information in accordance with our Privacy Policy. By opting for our services, you acquiesce to the collection and use of your data in the way outlined in our Privacy Policy.

11. Intellectual Property
